Children’s Promise PurposeVision: The Australian public and a Consortium of leading social profit organisations coming together to give Australian children and young people the opportunity to reach their full potential.
Mission: To promote, develop and raise funds for a Consortium of leading social profit organisations that work holistically to support Australia’s children and young people realise their full potential.
The primary value proposition of CP is the development of a reliable regular source of untied funds. Most smaller charities find it impossible to set up successful annual appeals and therefore often do not have a steady source of income leading to sustainable income stream (over reliance on government, trust and foundations etc.) Children’s Promise aims to address this issue by bringing together 10 different charities and setting up and annual appeal for all of them and sharing the funds equally between them.
Children's Promise has just prepared a business plan including a five year budget and income projections and made one particular signficant change to the way it will administer funds raised from the general public which was not part of the original intent when Children's Promise was established.
We now need to ensure that the changes in direction are in line with both those legal documents and require relevant legal advice.
This job would entail:
• Obtain a briefing
• Review of the legal documents (trust deed and constitution) and the business plan (only 12 pages) and the current status document (2 pages)
• Compare legal obligation outlined in trust deed and constitution and provide informed advice whether the business model outlined in the business plan is consistent with legal requirements
• Point out gaps (if any)
Reason: When we set Children’s Promise up in 2003 the Trust was set up with a particular focus. Now that other people have become involved the focus has changed slightly. At the last committee meeting a few questions came up and the committee requested that we seek legal advice to ensure we are going in the right direction prior to designing the annual appeal and entering into agreements with beneficiaries.
Impact of task: it is absolutely essential for us before we can proceed with the implementation of a national public appeal to ensure it is in line with legal requirements. We cannot proceed without this advice.
